SDSC CRM-284 - REQUEST FOR MILITARY DIVERSION; ADVISAL AND WAIVER OF RIGHTS. This form is used by a criminal defendant who is a current or former member of the military to request participation in the Military Diversion Program under Penal Code § 1001.80. Military Diversion is a pretrial program that allows eligible service members or veterans charged with misdemeanor or felony offenses to receive treatment instead of proceeding with criminal prosecution. The defendant acknowledges and waives certain rights, including the right to a speedy trial, and agrees to provide proof of military service along with an assessment showing they suffer from sexual trauma, traumatic brain injury, PTSD, substance abuse, or mental health issues related to their service. The program lasts no more than two years and includes court-ordered treatment. If the defendant successfully completes the program, the charges are dismissed, and the arrest is deemed never to have occurred—except when applying for a peace officer position, where disclosure is still required.
