CVRC8 - REQUEST and AFFIDAVIT FOR ENTRY OF DEFAULT JUDGMENT. This form used in the Pima County Justice Courts in Arizona is filed by a plaintiff (or counterclaimant or third-party plaintiff) who is seeking a default judgment against a defendant who has failed to respond to a lawsuit within the legally required time frame. After a Summons, Complaint, and Notice to Defendant have been properly served, and at least ten business days have passed since a default was entered without any answer or other response from the defendant, the plaintiff may request that the court enter a judgment in their favor by default. This form requires the plaintiff to certify, under penalty of perjury, that all necessary documents were served and that no response was received within the legal time limits. The plaintiff must also state whether the defendant is or is not on active duty in the U.S. military, as federal protections apply to service members under the Servicemembers Civil Relief Act (SCRA). The form includes a breakdown of the amounts claimed, such as the principal, court costs, attorney fees, interest, and the total amount due. Supporting documentation, including a proposed judgment, statement of costs, and proof of the debt, must be attached.
