Description

PCT/ISA/209, NOTIFICATION OF FACTS WHICH SHOULD HAVE PRECLUDED THE ACCORDING OF AN INTERNATIONAL FILING DATE (PCT Rule 29.3). This form is used by the International Searching Authority (ISA) to notify the applicant of facts that should have precluded the according of an international filing date for an international patent application under the Patent Cooperation Treaty (PCT). PCT Rule 29.3 provides that if the ISA finds that the international application does not comply with the requirements for the international filing date, it shall, as soon as possible, notify the applicant of the deficiencies and give the applicant an opportunity to correct them. This includes the applicant lacking the right to file the application, the description and claims not being in the prescribed language, the application not containing an indication that it is intended as an international application, the name of the applicant not being provided, and missing or incorrect parts of the application. Based on these issues, the International Searching Authority believes that the receiving Office should consider the application as withdrawn, in accordance with Article 14(4) and Rule 30.1 of the Patent Cooperation Treaty. www.FormsWorkflow.com
