PCT/ISA/203, DECLARATION OF NON-ESTABLISHMENT OF INTERNATIONAL SEARCH REPORT (PCT Article 17(2)(a), Rules 13ter.1(c) and (d) and 39). This form is used in the Patent Cooperation Treaty (PCT) process. When an applicant files an international application under the PCT, the International Searching Authority (ISA) usually conducts a search to identify relevant prior art. However, in some cases, the applicant may choose not to have an international search conducted by the ISA. This might be because the applicant has already conducted their own search and believes it is sufficient, or because they want to save time and money. In such cases, the applicant must file the Declaration of Non-Establishment of International Search Report (PCT/ISA/203) with their international application. This form declares that the applicant does not want an international search report to be established by the ISA. By filing this form, the applicant waives their right to receive an international search report and the written opinion of the ISA. This means that the applicant will not have the benefit of the ISA's assessment of the prior art and its relevance to the claimed invention.
