PETITION FOR INVOLUNTARY TREATMENT. This Florida Circuit Court form is used to request a court order for involuntary substance abuse treatment under Chapter 397, Florida Statutes (the Marchman Act). The petitioner—such as a spouse, parent, guardian, relative, treatment provider, or adult with personal knowledge—swears that the respondent is substance abuse–impaired, has lost self-control, and meets the statutory criteria for involuntary admission. The form requires detailed descriptions of the respondent’s behavior, risks of self-harm or harm to others, refusal of voluntary care, and recent assessments by qualified professionals. Petitioners may also request an ex parte order for immediate assessment or stabilization in emergencies.
