AOPC 312-05 - NOTICE OF APPEAL FROM MAGISTERIAL DISTRICT JUDGE JUDGMENT. This form is used in the Commonwealth of Pennsylvania to initiate an appeal to the Court of Common Pleas after a judgment has been issued by a Magisterial District Judge (MDJ). This form is completed by the party seeking the appeal, known as the appellant, and must include identifying information about the original case, including the names of the parties, the date of the MDJ’s judgment, and docket numbers. Once filed, the Notice of Appeal serves to notify the Court of Common Pleas that the appellant is challenging the lower court’s decision. In certain cases, this appeal may act as a supersedeas, temporarily stopping enforcement of the judgment (such as eviction), until the higher court makes a decision. If the appellant was the original claimant, they must file a formal complaint in the Court of Common Pleas within 20 days of the appeal. If the appellant was the original defendant, the form may also include a Praecipe to Enter Rule to File Complaint, which requires the opposing party to file a complaint within 20 days or face a judgment of non pros (dismissal). The form must also include proof that copies of the notice were served on both the MDJ and the opposing party, either in person or by certified mail, with confirmation of service filed within 10 days. www.FormsWorkflow.com
