Description

CR-164 - RETAIL CRIME RESTRAINING ORDER—CRIMINAl (CLETS-RCO). This form is used by the Superior Court of California to issue a postconviction restraining order under Penal Code section 490.8(a) against a person convicted of committing a crime involving a retail establishment. This order is designed to protect specific retail locations by legally prohibiting the restrained individual from entering or being near the named retail establishment(s), including their grounds and adjacent parking areas. The form includes critical identifying information about the restrained person, such as name, physical description, and date of birth, to ensure proper enforcement. It also identifies the protected business and, if applicable, any additional related store locations. The court can issue the order following a hearing or without a hearing if the restrained person is present. The order may remain in effect for up to two years unless a different expiration date is specified. Violating the terms of this restraining order may lead to arrest and criminal charges. The form also provides law enforcement with clear instructions for service, verification, and enforcement of the order through the California Restraining and Protective Order System (CARPOS), ensuring the protected retail establishment’s safety is upheld throughout the state.
