CR-163 - FINDINGS AND ORDERS REGARDING PROHIBITED ITEMS WHILE ON DIVERSION. This form is used when a court grants mental health diversion under Penal Code section 1001.36 or military diversion under section 1001.80. The form documents the court’s required findings—made by clear and convincing evidence—that the defendant poses a significant danger of personal injury if allowed to possess firearms, firearm parts, ammunition, deadly weapons, or body armor, and that no less restrictive alternative is adequate. CR-163 records the duration of the prohibition, identifies the charges, and specifies the defendant’s obligations to relinquish prohibited items.
