Description

MOTION FOR INSTALLMENT PAYMENTS. This form is used in the Circuit Court of Knox County, Tennessee, by a defendant who has had a judgment entered against them and is requesting to pay the judgment in smaller, manageable installment payments rather than in one lump sum. This motion is filed under Tennessee Code Annotated §26-2-216 and must be supported by an attached Affidavit of Income and Property, which provides the court with detailed financial information about the defendant’s income, debts, assets, expenses, and dependents. The purpose of the form is to demonstrate to the court that the defendant does not have other sources of income or property and that the proposed payment plan reflects the maximum amount they can reasonably pay. The court will review the motion, and if good cause is shown, it may approve the installment payment plan and stay further wage garnishments or other collection efforts, provided the defendant complies with the payment schedule. If the defendant fails to show cause, fails to appear, or has already defaulted on a prior installment agreement, the motion may be denied, and collection efforts may continue. www.FormsWorkflow.com
