MOTION TO QUASH GARNISHMENT / EXECUTION AND CLAIM EXEMPTION RIGHTS. This is a form used in Tennessee Circuit Courts, such as Knox County, to request the release or return of money or property that has been garnished or seized to satisfy a judgment. This motion is filed by the judgment debtor under the authority of Tennessee Code Annotated §§ 26-2-101 through 26-2-410, which protect certain types of income and property from collection. The judgment debtor must specify the grounds for exemption, which may include: Social Security benefits, SSI (Supplemental Security Income), unemployment or veterans benefits, TANF (Temporary Assistance for Needy Families), pensions, insurance benefits, health care aids, tools of trade, or wages garnished beyond legal limits. The debtor must also identify the garnishee or employer and the financial institution or third party from which the funds were taken. A hearing must be scheduled within 14 days of filing, as required by Tenn. Code Ann. § 26-2-410. At the hearing, the court will determine whether the garnished funds or property are legally exempt and whether the garnishment or execution should be quashed.
