Form 5-2 - PATERNITY PETITION (PERSON OTHER THAN PARENT; REPRESENTATIVE OF SOCIETY OR AGENCY). This form is used in the New York State Family Court by a guardian, next of kin, person standing in a parental relation, or an authorized representative of a charitable or social services agency to initiate a proceeding establishing legal paternity of a child. Authorized under Family Court Act § 523 and Social Services Law § 111-g, the petition allows non-parent individuals or agencies to seek a court determination that identifies the father of a child born—or likely to be born—out of wedlock. The form includes detailed sections for the petitioner’s information and relationship to the child, the mother’s and alleged father’s details, acknowledgment or support history, and any existing court determinations of paternity. It also requires information about Native American heritage for compliance with the Indian Child Welfare Act (ICWA) and an optional request for child support services through New York’s Support Collection Unit (Title IV-D Program). The petition concludes with a verification under penalty of perjury and, if filed by an agency, a separate Agency Verification affirming knowledge of the case facts. The document warns that any resulting support order may later be subject to automatic cost-of-living adjustments (COLA) as provided by the Family Court Act § 413.
