Form 5-1 - PATERNITY PETITION (INDIVIDUAL). This is a New York Family Court form used to establish legal paternity for a child born or expected to be born out of wedlock under Family Court Act §§ 522 and 523 and Social Services Law § 111-g. This petition may be filed by the child’s mother, alleged father, or a person claiming to be the father. It requests the court to issue an order declaring paternity and, if applicable, a corresponding child support order. Petitioners may also request genetic testing.
