Description

Form TPR-6 - PETITION (ABANDONMENT). This is used in a New York Family Court to request termination of parental rights on the ground of abandonment. The petition may be filed by an authorized agency, foster parent, or attorney for the child, and it asks the court to commit guardianship and custody of a child under 18 to an agency or foster parent for the purpose of adoption. The petitioner must allege that the parent(s) have failed for at least six months prior to filing to communicate with or visit the child, despite having the ability to do so and without interference from the agency. The form requires information about the child’s identity, parents, custodians, and any other individuals entitled to notice, as well as a statement regarding compliance with the Indian Child Welfare Act (ICWA) if applicable. It must also describe the child’s placement history and the reasons why termination and commitment are in the child’s best interests. The petition warns that granting it may permanently terminate parental rights and allow the child to be adopted without consent.
