SFCIV-030 - ASBESTOS – EXHIBITS I ASBESTOS FORMS. This set of forms, authorized by the Superior Court of California, County of San Francisco, is used in asbestos litigation to obtain various categories of personal records relevant to a plaintiff’s case. These include medical and billing records, employment and union files, health and welfare documentation, and death certificates. The forms authorize the release of sensitive information to RecordTrak, a third-party retrieval company, for use as evidence. Each form complies with HIPAA and incorporates specific authorizations under federal and state privacy laws, including the Federal Confidentiality Law, the Federal Privacy Act, and the California Confidentiality of Medical Information Act. They permit the release of extensive documentation, such as diagnostic reports, employment history, and benefit records, crucial for establishing asbestos exposure and health impacts. Plaintiffs’ attorneys are granted a review period—typically 21 days, or 7 days if trial preference is indicated—before records are released to defendants.
