Stipulation To Terminate An Income Withholding Order

STIPULATION TO TERMINATE AN INCOME WITHHOLDING ORDER. This form is used in the Coconino County Superior Court when both parties in a family law case agree to end a previously issued Income Withholding Order (IWO). An IWO is typically used to have a paying party’s employer deduct court-ordered child support or spousal maintenance directly from their wages. This stipulation allows the parties to request termination of the IWO by confirming that all past-due amounts have either been paid or waived, or that the obligation has ended. For child support, this may happen when all children named in the order have turned 18 and are no longer in high school, or if they have been adopted, married, or are deceased. For spousal maintenance, it may end due to remarriage or death of the receiving party, or for other valid reasons. The form requires the names of both parties, the date of the original order, the current support amount, and the name and address of the paying party’s employer. Both parties must sign the form in front of a notary or court clerk, and if either receives Title IV-D services from the Division of Child Support Services (DCSE), a representative from the Attorney General’s Office must also sign.
