LBF-J1 - ORDER ASSIGNING MATTER TO THE BANKRUPTCY DISPUTE RESOLUTION PROGRAM AND APPOINTING RESOLUTION ADVOCATE. This form is issued by the United States Bankruptcy Court for the District of Maryland. It is used in either an adversary proceeding or a contested matter when the parties involved agree to resolve their disputes through the Court’s Bankruptcy Dispute Resolution Program (BDRP). The purpose of this order is to refer the disputed matter to mediation rather than proceeding immediately through litigation. The court designates a Resolution Advocate—either a judge or a non-judge mediator—to facilitate the resolution process. If the appointed advocate is not a judge, the order typically requires the parties to share the mediator’s fees equally unless they agree otherwise. When a judge serves as the mediator, they retain judicial immunity related to the mediation process. The order sets deadlines for completing the BDRP conference and for filing a joint status report with the court. It also outlines the responsibility of counsel—usually for the plaintiff or movant—to promptly provide the Resolution Advocate with a copy of the order and contact information for all participants.
