The Standby Guard ian Advocate shall be empowered to assume the duties of his /her office immediately upon the de ath, removal or resignation of the Guardia n Advocate of the Persons with Developmental Disabilities. 3. Within 20 days after assumption of duties as Guardian Advocate , the Standby Guardian Advocate shall p etition for confirmation of appointment and submi t to a criminal background record check and if the court finds that the Standby Guardian to be qualified to serve as Guardian Advocate pursuant to 247 744.309 and 247744.312 , Florida Statutes , appointment of Guardian shall be confirmed. 4.
