CIV-048, APPLICATION FOR PUBLICATION OF SUMMONS/CITATION, A cause of action exists against defendant/respondent/citee upon whom service is to be made, or he or she is a necessary or proper party to the action, or the party to be served has or claims an interest in real or personal property in this state that is subject to the jurisdiction of the court, or the relief demanded in the action consists wholly or in part in excluding such party from an interest in such property. A declaration under penalty of perjury pursuant to the laws of the State of California, based upon my personal knowledge or other admissible evidence, is attached and contains all of the following: 1. Facts showing the existence of each element of each cause of action I have alleged against the defendant/respondent/citee herein or showing the defendant/respondent/citee is a necessary or proper party to this action or 2. Facts showing the party to be served claims an interest in real or personal property in this state that is subject to the jurisdiction of the court, or the relief demanded in the action consists wholly or in part in excluding such party from an interest in such property. A copy of the summons or citation and the complaint or petition could not be served in any matter as provided in the Code of Civil Procedure. I used reasonable diligence and made inquiry of appropriate public databases and relatives and/or associates who might know the whereabouts of the defendant/respondent/citee and have not been able to ascertain a present address. Efforts made to determine the location of the dwelling house, normal place of abode, or the usual place of business of the defendant/respondent/citee are attached.
