Form TPR-4 - PETITION (TERMINATION OF PARENTAL RIGHTS -- PARENTS DECEASED). This form is used in New York Family Court to request the commitment of guardianship and custody of a child whose parents are both deceased and for whom no legal guardian has been appointed. The petition may be brought by an authorized agency, foster parent(s), the child’s attorney, or a guardian ad litem acting at the court’s direction. The petitioner must include the child’s identifying information, attach proof of the parents’ deaths, and list all individuals entitled to notice of the proceeding or any potential adoption, as required under Domestic Relations Law §111-a. The form also accounts for compliance with the Indian Child Welfare Act (ICWA) when applicable.
