Description

NOTICE OF UNSUPERVISED ADMINISTRATION TO BE MAILED TO A DISTRIBUTEE. This form is used by the Allen Superior Court, Probate Division, in the State of Indiana to inform an heir, devisee, or legatee (collectively referred to as a "distributee") that a personal representative has been appointed to administer the estate of a deceased individual without court supervision. The notice explains that the personal representative was appointed on a specific date and outlines the decedent’s status regarding whether or not they left a will. It informs the distributee of their rights and the procedures that will follow during the administration. These include the representative’s authority to act independently, the possibility that no bond has been posted, the right to petition the court for a bond or for supervised administration, and the right to remove a corporate personal representative under certain conditions. It also explains that the personal representative is not required to seek court approval for fees or actions taken and must prepare an inventory of the estate within two months. Distributees are entitled to request a copy of the inventory and must receive a copy of the closing statement when the estate is finalized. If the distributee's interest is affected, they are entitled to a full written accounting. Any objections to the closing statement must be filed within three months after it is submitted, or the estate will be considered closed without court review. The notice serves to protect the distributee's interests and ensure they are aware of their rights throughout the unsupervised administration process, as governed by Indiana Code 29-1-7.5-1.5(d). www.FormsWorkflow.com
