Description

300.55 Measure of Damages to Easement Strip--Overhead Electric Transmission Line--Fact of Damage Contested If you find there will be damage to that part of the easement strip not occupied by the structures, the measure of that damage is the difference between the fair cash market value of that part of the easement strip immediately before the structures are in place and its fair cash market value immediately after the structures are in place. [In arriving at the damages to that part of the easement strips which are not occupied by structures, you should take into consideration the fact that the owners will have and retain all the uses of said easement strips not inconsistent with the right to construct, operate and maintain the said transmission line.]
