ASBESTOS DISCLOSURE RE: PURCHASE AGREEMENT EXCHANGE AGREEMENT Pertaining to the property described as LEASE AGREEMENT Between and Date BE ADVISED that there may be the presence of asbestos in certain types of sprayed ceiling covering and other building materials used in the construction of homes prior to the use of these materials being banned. Said materials were banned during the years between 1977 and 1979. Reports by government and private agencies have shown that asbestos fibers may be airborne and may present a health hazard. Lessee must initial one of the following paragraphs: 1. Lessee acknowledge receipt of the booklet prepared by the U.S. Consumer Product Safety Commission and the U.S. Environment Protection Agency entitled "Asbestos at Home". Lessee has the option for days from acceptance of the above Agreement to order, at Lessee's expense, an Inspection and laboratory analysis on the property regarding whether asbestos is present. If the written report of the analysis indicated the presence of asbestos, Lessee, in Lessee's discretion, may terminate this Agreement and have all deposits returned, minus any fees necessary for the said inspection. 2. Lessee acknowledge receipt of the booklet prepared by the U.S. Consumer Product Safety Commission and the U.S. Environment Protection Agency entitled "Asbestos t Home". Lessee elects to waive the right to have the property inspected for the purpose of determining the presence of asbestos materials used in the construction of the home. Lessee accepts the property as it exists in its current condition. Lessee acknowledge that Lessee has not received any representations by the Brokers or the Lessor regarding the presence, or absence, of asbestos on or about the property.
