CCP 0224 - ORDER APPOINTING STANDBY GUARDIAN OF A PERSON WITH A DISABILITY. This form is used in the Probate Division of the Circuit Court of Cook County, Illinois to formally appoint a standby guardian for a person with a disability. This order is based on a petition filed by an interested party, such as a current guardian, family member, or caregiver, and is granted when the court determines that having a standby guardian is in the disabled person's best interest. A standby guardian is someone designated to assume guardianship responsibilities in the future if the current guardian is no longer able or willing to act—whether due to death, resignation, or incapacity. This order may appoint either a limited or plenary standby guardian for the person, estate, or both, depending on the needs of the individual and the scope of the guardian's responsibilities. The form also allows for the appointment of a successor standby guardian, in case the first standby guardian is unavailable. This order does not grant immediate authority to the standby guardian. Instead, it outlines that the standby guardian’s authority to act will begin only upon learning of the current guardian’s death, consent, or inability to perform their duties. At that point, the standby guardian may temporarily act for up to 60 days (for personal guardianship), pending further court approval.
