Description

P-2.0800 - PETITION TO ADMIT FOREIGN WILL TO RECORD. This FLSSI form is used in the Circuit Court for a specific county in Florida for the purpose of filing a petition to admit a foreign will to record. It is used when the deceased person (decedent) had a will that was probated in another jurisdiction (domiciliary probate proceedings), and the petitioner wishes to have that will recognized and recorded in Florida. The form collects information about the petitioner's interest in the estate, their address, and the name and address of their attorney. It includes details about the decedent, such as their last known address and date of death, and whether more than two years have elapsed since their death and whether the domiciliary personal representative has been discharged. The petitioner must attach an authenticated transcript of the relevant portions of the domiciliary proceedings, including the foreign will, any codicils, the petition for probate, and the order admitting the will to probate. The form also specifies that the will must have been executed as required by Florida Statutes Chapter 732, and it states that there have been no proceedings to administer the estate of the decedent in the state of Florida. The petitioner requests that an order be entered admitting the foreign will to record. The form concludes with the petitioner's declaration under penalties of perjury, stating that the facts alleged are true to the best of their knowledge and belief. The petitioner and their attorney's details, including their names, contact information, and signatures, are printed or typed at the end of the form.
