P-2.0850 - AFFIDAVIT UNDER SECTION 735.303, FLORIDA STATUTES, TO OBTAIN BANK PROPERTY OF DECEASED ACCOUNT HOLDER. This form is used in the state of Florida under Section 735.303 of the Florida Statutes to obtain bank property of a deceased account holder. The affidavit is sworn by the affiant, who is related to the decedent and is entitled to payment of the funds in the decedent's depository accounts and certificates of deposit held by a specific financial institution. The affiant confirms their relationship to the decedent, provides the date of death and last residence of the decedent, and states that they are entitled to the funds in the decedent's accounts. They also affirm that no personal representative has been appointed for the decedent's estate, no probate proceeding has been initiated, and there is no knowledge of any will or other document regarding the distribution of the estate. The affiant agrees that payment of the funds from the financial institution constitutes a full release and discharge of the institution. They acknowledge personal liability to creditors and other rightful claimants if the amount paid exceeds the affiant's share.
