If the product is a domestic malt beverage and the brewer or bottler stated on the label is not the same as the trade name listed on your license/permit, please attach an approved DBA or a copy of your Federal Brewer222s Permit listing the Trade Name. 4. Submit two (2) samples of the product for which label approval is desired. If more than one size is requested on this application, submit two (2) samples of the largest size (not exceeding 168 ounces or 5 liters). By set of labels is meant all brand, strip, neck, and back labels appearing on any individual container. An exact color reproduction will be accepted if an original label is not available. Since a certificate will be issued for each size, we must have a set of labels for each size. Beer: a malt beverage containing not more than 4% of alcohol by weight. Ale or Malt Liquor: a malt beverage containing more than 4% of alcohol by weight. Labels must state a Texas malt beverage classification of Beer, Ale, or Malt Liquor. In lieu of the classification, the label shall include the Alcohol By Volume (ABV) percentage.
