Description

PCT/ISA/207, INFORMAL CLARIFICATION:NOTE/INVITATION (PCT Article 17(2) and PCT/GL/ISPE paragraphs 9.34 and 9.35). This form is used in the Patent Cooperation Treaty (PCT) process. When an applicant files an international application under the PCT, the International Searching Authority (ISA) usually conducts a search to identify relevant prior art. If the ISA identifies prior art that it considers relevant to the claimed invention, it will issue a written opinion that sets out its findings and conclusions. If the applicant has chosen not to have an international search conducted by the ISA (under PCT Article 17(2)(a)), the ISA may still issue a Note/Invitation to provide the applicant with an informal clarification of the issues involved in the application. This is done to help the applicant understand the potential relevance of the prior art identified by the ISA and to encourage them to consider whether they want to amend the claims or provide additional information to overcome any potential issues. The Informal Clarification: Note/Invitation (PCT/ISA/207) is used by the ISA to communicate with the applicant in such cases. The form sets out the issues involved and invites the applicant to provide a response. It is an informal communication and does not constitute an official action by the ISA. It does not require a formal response from the applicant, nor does it have any legal effect on the examination process. The use of the Note/Invitation is governed by PCT/GL/ISPE paragraphs 9.34 and 9.35, which provide guidance on the circumstances in which it may be appropriate to issue such a communication.
