DOCKET NO. (court use only)The below-named and undersigned Judgment Creditor (Plaintiff) hereby makes Application for Supplementary Process against the below-named Judgment Debtor (Defendant) for payment of the unsatisfied civil judgment described below. NAME AND ADDRESS OF JUDGMENT CREDITOR (PLAINTIFF) (to be completed by Judgment Creditor ) NAME AND CURRENT ADDRESS OF JUDGMENT DEBTOR (DEFENDANT) (to be completed by Judgment Creditor) INSTRUCTIONS TO THE JUDGMENT CREDITOR (PLAINTIFF): Supplementary process is a procedure used to bring into court a judgment debtor who has refused to voluntarily pay a civil money judgment in order to examine the judgment debtor's ability to pay the judgment and to seek a court order to compel payment. See Mass. Gen. Laws c. 224, 24714. A supplementary process proceeding may be brought in the District Court or Boston Municipal Court division where the judgment debtor lives or has a usual place of business or employment. However, if this proceeding is incidental to a case or matter in a Housing Court division then it must be brought in said Housing Court division. If applicable, the Fair Debt Collection Practices Act, 15 U.S.C.A. 2472471692 et seq., may contain additional requirements that a judgment creditor must comply with before commencing a supplementary process proceeding. To begin this procedure, this application must be completed and then filed with the clerk's office along with the required entry fee. You do not have to, but you may file the original or a copy of the order of judgment or execution with this application. However, at the supplementary process hearing, you will be required to present the original execution or other certified proof of the unpaid money judgment. Upon the payment of the required entry fee, the clerk's office will issue a summons under court seal to you to be served on the judgment debtor at least 7 days before the hearing date noted on the summons.
