F 1017-1.1.MOTION.DEBTOR.CONVERT, DEBTOR'S MOTION TO CONVERT CASE UNDER 11 U.S.C. §§ 706(a) OR 1112(a), LBR 1017-1(a)(3) provides the procedure for a chapter 11 debtor to request an order converting a chapter 11 case to another chapter. A fee may be required. A motion is required . A hearing is not required. The parties must file a Notice of Motion for Order Without Hearing under LBR 9013-1(p). Before a chapter 11 case is converted, all pending court costs and U.S. trustee fees must be paid. When a motion to convert a chapter 11 case is filed, the court may file a Notice of Court Costs if court costs remain unpaid and the U.S. trustee may file a notice to indicate the amount of U.S. trustee fees that remain unpaid. 11 U.S.C. §§ 706(a) - The debtor may convert a case under this chapter to a case under chapter 11, 12, or 13 of this title at any time, if the case has not been converted under section 1112 , 1208 , or 1307 of this title.  Any waiver of the right to convert a case under this subsection is unenforceable. 11 U.S.C. §§ 1112(a) - (a) The debtor may convert a case under this chapter to a case under chapter 7 of this title unless— (1) the debtor is not a debtor in possession; (2) the case originally was commenced as an involuntary case under this chapter; or (3) the case was converted to a case under this chapter other than on the debtor’s request. www.FormsWorkflow.com
