(Copy of petition attached) The Court finds the defendant factually innocent of the charge(s) (under Penal Code §851.8) for which the arrest was made. The Court orders the law enforcement agency having jurisdiction over the offense, the Department of Justice, and any law enforcement agency which arrested the petitioner (or participated in the arrest) to seal the records of the arrest, including the order to seal and to destroy such records. This order to seal shall be for three years from the date of the arrest. Thereafter, the records of the arrest and the order to seal and destroy such records shall be destroyed, unless at that time a civil lawsuit by the petitioner or a co-defendant in the criminal action (if any) is pending against any law enforcement agency which arrested the petitioner (or participated in the arrest), and that agency has been served with a certified copy of the civil complaint. If such civil lawsuit is pending, the records of arrest and the order to seal and destroy such records shall remain sealed until the civil lawsuit is resolved, and be destroyed thereafter. The Court orders the law enforcement agency having jurisdiction over the offense and the Department of Justice to request the destruction of any records of arrest which they have given to any local, state, or federal agency, person or entity.
