62.740 Negligent Construction The plaintiff has alleged that the defendant is liable in damages for negligent construction. I charge you that an action for negligent construction arises when one fails to perform work in accordance with industry standards. From the evidence, you must first determine what the standards of the construction industry are with respect to the improvements made by the defendant for the plaintiff. You then must decide whether the defendant's construction was done in a manner that was in conformity with those standards. If you find that the defendant failed to meet industry standards and that the failure resulted in damages to the plaintiff, you would be authorized to return a verdict for the plaintiff.
