36.200 Landlord and Tenant; Liability of Landlord; Generally The landlord is responsible to others for damages arising from a. defective construction or b. failure to keep the premises in repair after having notice of a defect and an opportunity to repair. However, once the landlord has fully parted with possession and the right of possession, the landlord is not responsible to third persons for damages resulting from negligence or illegal use of the premise by the tenant.
