Description
Form 3DC52 - ORDER GRANTING PETITION FOR INJUNCTION AGAINST HARASSMENT. This form is issued by the District Court of the Third Circuit in Hawai‘i following a hearing on a petition for protection against harassment. This form is used to officially document the court’s decision to grant the petitioner a final injunction after finding that harassment occurred, or is likely to occur, based on clear and convincing evidence, the respondent’s stipulation, or the respondent’s failure to appear. The order extends and makes permanent any temporary restraining order previously issued, specifying that the respondent—and anyone acting on their behalf—is prohibited from contacting, harassing, telephoning, or visiting the petitioner, as well as entering the petitioner’s residence or workplace. It also prohibits the respondent from owning or possessing firearms or ammunition during the period the injunction is in effect, requiring any such items to be surrendered to the police for safekeeping. The injunction is legally binding for a specified period, which may be up to several years, and includes conditions for enforcement by law enforcement officers, who are authorized to arrest the respondent if the order is violated. Violations of the injunction are punishable under Hawai‘i law, including specific penalties for violations related to firearms. www.FormsWorkflow.com
