Description

Form 3DC51 - PETITION FOR EX PARTE TEMPORARY RESTRAINING ORDER AND FOR INJUNCTION AGAINST HARASSMENT; DECLARATION OF PETITIONER(S); TEMPORARY RESTRAINING ORDER AGAINST HARASSMENT; AND NOTICE OF HEARING. This form is used in the District Court of the Third Circuit in Hawai‘i by individuals seeking immediate court-ordered protection from harassment. This form allows a petitioner to request a temporary restraining order (TRO) and, eventually, a longer-term injunction against a respondent who has allegedly engaged in recent or ongoing acts of harassment, or who has made threats likely to lead to such acts. The petition is supported by a declaration from the petitioner detailing specific incidents or threats, including information about any firearms or weapons the respondent may possess. If the court finds probable cause, it may issue a TRO—effective for up to 15 days—prohibiting the respondent from contacting, threatening, or coming near the petitioner, their home, school, or workplace. The order may also require the respondent to surrender firearms or electric weapons. A court hearing is scheduled where both parties can present evidence, and the court will determine whether to issue a longer injunction (up to three years). Violations of the TRO are criminal offenses. www.FormsWorkflow.com
