Order Regarding Extradition {MC 270}

Form MC 270 - ORDER REGARDING EXTRADITION. This form is used in the State of Michigan to record the court’s decision in an extradition matter involving a fugitive defendant. It applies in cases under either the Uniform Extradition Act or the Interstate Agreement on Detainers when a Governor’s Warrant or an Interstate Agreement on Detainers form has been filed. This form allows the court to set a deadline for the defendant to file a petition for a writ of habeas corpus challenging the legality of their arrest, schedule a hearing on such a petition, or determine whether the arrest was legal or illegal. Based on the court’s findings, the order will either direct that the defendant be released or authorize their transfer to the agents of the demanding state.
