This Delaware Justice of the Peace Court form is required for landlords who have filed a complaint for summary possession (eviction). The affidavit certifies that the landlord has actively participated in the Court’s eviction diversion program, which may include registering with the program, communicating with the tenant or a mediator, and attending a mediation conference. The affidavit must be filed with the Court no earlier than 15 days after the summons is issued and no later than five days before the scheduled eviction hearing.
