Form PCM 214 - INITIAL ORDER AFTER HEARING ON PETITION FOR MENTAL HEALTH TREATMENT. This form is used by a Michigan Probate Court to document the outcome of a legal proceeding determining whether an individual is a person requiring mental health treatment under state law. Following the filing of a petition and a court hearing—at which the individual and attorneys for both parties may be present—the court evaluates testimony and other evidence to decide whether the person has a mental illness that poses a risk of harm to themselves or others, prevents them from meeting basic needs, or causes impaired judgment that interferes with voluntary treatment. If the court finds by clear and convincing evidence that treatment is necessary, it may order the individual to be hospitalized, receive assisted outpatient treatment, or both, for a specified duration—up to 60 days for hospitalization alone or up to 180 days for outpatient care. The order includes detailed conditions of treatment and outlines required services such as medication, therapy, testing, case management, or vocational training. It also includes instructions for law enforcement, if necessary, to enforce hospitalization, and may trigger reporting requirements to the Michigan State Police or prosecutors if the individual has prior felony charges.
