CR-367 - MOTION AND ORDER RE REMISSION OF JUDGMENT OF FORFEITURE. This form is used in the Alaska District or Superior Court when a party seeks the return, in whole or in part, of bail money that was previously forfeited by court order. This motion must be filed within one year of the forfeiture judgment and is governed by Criminal Rule 41(h)(4). The person filing the motion must explain why remission is justified, either by demonstrating that they assisted in returning the defendant to court or by showing extraordinary circumstances, and must provide supporting details in an affidavit. The form requires attaching a copy of the forfeiture judgment, serving copies to all relevant parties (such as the prosecutor, defendant, and the individual or company that posted the bail), and signing before a notary or court clerk. The judge then reviews the request and may deny, partially grant, or fully grant remission, with any amounts already applied to restitution excluded from remission by law. Crim.
