DWC Form 4 - EXHIBIT A: CONFIDENTIAL DIVISION OF PROPERTY & DEBTS & VALUES. This form is part of the Filing for Divorce Together – With Children packet provided by the North Dakota Legal Self Help Center. It is used by spouses who have minor children and who are filing jointly for divorce while agreeing in writing on every issue, including property and debt division. This form details how all assets and liabilities are valued and divided between the Plaintiff and Defendant. It includes sections for jointly owned and individually owned real estate, vehicles, personal property, retirement accounts, life insurance, business or farm interests, financial accounts, and secured or unsecured debts. The document allows both spouses to list the fair market value, date of valuation, and any loans or liens associated with each asset. Once completed, the form provides a summary table showing each spouse’s total assets and debts to ensure equitable distribution. The division of property and debt must comply with North Dakota Century Code §14-05-24, which requires an equitable—not necessarily equal—distribution based on the circumstances of the marriage. This includes consideration of each spouse’s age, health, income, contributions, and financial needs. Once signed by both spouses and approved by the court, the division becomes final and enforceable. Both spouses must sign and date the completed form under penalty of perjury before a notary public or clerk of court.
