Motion To Reopen {MTR-1}

Form MTR - MOTION TO REOPEN. This form is used to request the reopening of a workers’ compensation claim under KRS 342.125. Grounds for reopening include a change in disability supported by objective medical evidence, fraud, mistake, newly discovered evidence, adjusting awards to match an employee’s work status, reducing permanent total disability awards after return to work, or medical disputes (which must also include a Form 112). The motion must be supported by documentation such as affidavits, medical reports, a signed Form 106 (medical release), and copies of the prior award, settlement, or order. Parties must certify accuracy, and service of the motion must be made on all relevant parties via mail or delivery per CR 4.01(b).
