SECURED LEAVE NOTICE. This form is used by attorneys practicing in the State of North Carolina to formally request protected time off from court proceedings under Rule 26 of the General Rules of Practice for the Superior and District Courts. This form allows an attorney to designate specific weeks during which they will be unavailable—whether for vacation, personal reasons, or family leave, such as within 24 weeks of the birth or adoption of a child—without the risk of court hearings, trials, depositions, or other legal proceedings being scheduled during that time. The attorney must certify that the request is not being made to delay or interfere with any case and that no matters are currently scheduled during the requested leave period. The form also requires the attorney to list any previously designated secured leave periods for that calendar year. To be valid, this notice must be served at least 90 days before the start of the leave period and must be sent to the appropriate judicial officials and clerks, such as the Senior Resident Superior Court Judge, Chief District Court Judge, District Attorney, and Clerk of Superior Court, depending on the nature of the cases involved.
