EERA Representation Petition {PERB-2110}

PERB-2110 - EERA REPRESENTATION PETITION. This form is used under the Educational Employment Relations Act (EERA) to request formal recognition or changes to union representation for a group of public school employees in California. This petition can be filed by an employee organization seeking to be recognized as the exclusive representative of a proposed bargaining unit, to sever a smaller group from an existing unit, or to intervene in an ongoing representation matter. Depending on the type of petition, it must be supported by proof that at least 30% (or a majority) of employees in the proposed unit support the action. The petition requires detailed information about the employer, the proposed bargaining unit (including who is to be included and excluded), any existing labor agreements, and other organizations that may have an interest in representing the same employees. Once filed, a notice of the petition must be publicly posted so that other interested parties may intervene if they meet certain criteria. A request for recognition, severance request or intervention is to be filed with the employer. Proper filing includes concurrent service and proof of service of the request/severance/intervention as required by PERB Regulations 33050 and 33070.
