Local Form CR-23 - ORDER APPROVING PROPERTY BOND AND RELEASE OF DEFENDANT. This form is used by the Superior Court of California, County of Stanislaus, to formally approve the use of real property equity as bail and to authorize the release of a defendant from custody. This order is issued after the court reviews and accepts an Application for Real Property Equity Bond pursuant to California Penal Code §1298. The applicant, typically a property owner associated with the defendant, submits a promissory note and deed of trust pledging real estate as security to ensure the defendant appears at all required court hearings. The court evaluates the application and verifies that the equity in the pledged property is at least twice the amount of the bail set. Upon approval, the court orders that the property bond be accepted in lieu of cash bail and directs the Stanislaus County Sheriff to immediately release the defendant from custody. This form also specifies that the bond covers particular criminal charges listed in the complaint, thereby officially recognizing the property as bail and documenting the conditions of the defendant’s release.
