Local Form CR-21 - PROMISSORY NOTE. This form is used by the Superior Court of California, County of Stanislaus in criminal cases where a defendant is released from custody on an undertaking or pledged security in lieu of posting cash bail. By signing this document, the person or persons providing the security—referred to as the "makers" or "depositors"—agree to pay a specified amount of money to the County of Stanislaus if the defendant fails to appear in court as required under California Penal Code Section 1305. This includes failure to appear for trial, sentencing, or any other required proceeding, and also applies if the defendant does not comply with court orders or becomes unavailable to the court. The promissory note is backed by a Deed of Trust, which secures the amount promised with real property or other pledged assets. If the defendant defaults on their obligation to appear, and the county is forced to enforce the note, the prevailing party in any legal action is entitled to recover costs and attorney’s fees.
