SUPCV 1097 - APPLICATION AND ORDER TO SERVE SUMMONS BY POSTING FOR UNLAWFUL DETAINER. This form is used in unlawful detainer (eviction) cases filed in the Superior Court of California, County of Santa Cruz, to request the court’s permission to serve a summons and complaint on a tenant by posting it on the rental property rather than through personal service. This application is made when the plaintiff (usually the landlord) or their representative has made multiple unsuccessful attempts to personally serve the tenant and cannot locate them through reasonable diligence. The form requires documentation of those attempts, such as times, dates, and reasons why service could not be completed. If the court finds that personal service is not feasible and that the plaintiff has a valid legal claim for possession of the property, it may authorize alternative service by posting the documents in a visible location at the property and mailing a copy to the tenant’s last known address.
