Description
SUPCV 429 - ORDER DETERMINING CLAIM OF EXEMPTION (ENFORCEMENT OF JUDGMENT). This form is used in the Superior Court of California, County of Santa Cruz, to document a judge’s decision on a judgment debtor’s Claim of Exemption during the enforcement of a judgment. After a hearing, the court records whether the exemption is granted or denied and specifies how funds or property should be distributed between the judgment creditor and debtor. The form also captures appearances by both parties and directs the clerk to notify the levying officer of the court’s order. It is typically used after a levy (such as wage garnishment or bank levy) when the debtor asserts that certain assets are legally exempt. Form Adopted for Optional Use. Code of Civil Procedure § 703.580. www.FormsWorkflow.com
