Description

SC-3031 - WAIVER OF DEFENDANT’S PERSONAL PRESENCE (PC §977). This form is used in the Superior Court of California, County of Santa Barbara, to allow a defendant to formally waive their right to be physically or remotely present during certain court proceedings. By signing this waiver, the defendant acknowledges that they have been informed of their constitutional rights—such as the right to be present at hearings, to confront witnesses, and to participate in arguments on questions of fact and law—and voluntarily chooses to give up those rights for specific motions or proceedings. The form authorizes the court to proceed in the defendant’s absence, with the understanding that their attorney will represent their interests as if they were personally present. The defendant agrees that any notice given to their attorney about a required court appearance will be considered sufficient notice to the defendant. This waiver must be signed by both the defendant and their attorney, and it is subject to the court’s approval, which is typically granted in open court. www.FormsWorkflow.com
