SC-3007 - ORDER GRANTING DEFERRED ENTRY OF JUDGMENT (PC 1000 et seq.). This form is used by the Superior Court of California, County of Santa Barbara, to formally approve a defendant’s participation in a Deferred Entry of Judgment (DEJ) program. This program is offered to first-time, non-violent drug offenders as an alternative to immediate prosecution and conviction. By signing this order, the defendant agrees to waive certain constitutional rights—such as the right to a speedy trial and jury trial—and to comply with specific conditions in exchange for the opportunity to have criminal charges dismissed upon successful completion of a court-approved drug treatment program. The district attorney must first confirm the defendant’s eligibility, and the court must determine that the defendant would benefit from such a program. Once enrolled, the defendant is required to actively participate in and complete the designated treatment program, obey all laws, submit to drug testing, avoid unlawful drug use, and pay a diversion restitution fee. Failure to comply with the terms may result in the termination of the DEJ agreement, a finding of guilt, and a sentencing hearing.
