AOC-CVM-203 - COMPLAINT TO ENFORCE POSSESSORY LIEN ON MOTOR VEHICLE. This form is used in North Carolina Small Claims Court to allow a business or individual who has legal possession of a vehicle to seek court approval to sell that vehicle in order to satisfy a valid possessory lien. This lien typically arises from services such as repairing, towing, or storing a vehicle when the owner fails to pay for those services. In some cases, it may also apply to abandoned vehicles left on private property for a designated period. The form is filed by the person or business (the plaintiff) holding the vehicle and claiming the lien, and it requires specific details including the vehicle’s make, year, ID number, the amounts owed for repair, towing, storage, or rental, and the dates possession began and notices were given. Before filing this complaint, the lien claimant must notify the North Carolina Division of Motor Vehicles (DMV) that the vehicle is unclaimed and that a lien is being asserted. The form also identifies the registered owner and any known secured parties (such as lenders), who must be listed as defendants and properly served.
