Description
AOC-CVM-204 - COMPLAINT IN EXPEDITED SUMMARY EJECTMENT VACATION RENTAL AGREEMENT. This form is used in North Carolina's District Court Small Claims Division to initiate legal proceedings against a tenant who has violated the terms of a short-term vacation rental agreement—specifically, one lasting 30 days or less. Filed by a landlord, property owner, or their authorized agent (such as a real estate broker or attorney), the form is designed to request immediate possession of the rental property when a tenant has refused to vacate the premises after the lease has ended or has breached the terms of the agreement. Common reasons for filing include holding over past the lease period, nonpayment of rent, material breaches of the rental agreement, or obtaining the rental through fraud or misrepresentation. The plaintiff must certify that proper notice—at least four hours—was given to the tenant before filing. The form includes essential details such as the location of the rental property, the parties involved, the rental rate, and the nature of the breach. If a real estate broker signs the complaint, they must certify they have direct knowledge of the facts. G.S. 42A-24. www.FormsWorkflow.com
